Terms of Service

These Terms of Service (“Terms”) are an agreement between you and XSkills (“XSkills,” “we,” “us,” or “our”), based in Los Angeles, California. By creating an account, purchasing a subscription, or using xskills.app or the XSkills service, you agree to these Terms.

Eligibility and accounts

The service is offered in the United States. You must have reached the age of majority where you live and be legally able to enter into this agreement. You must provide accurate account information, keep your credentials secure, and promptly notify us of suspected unauthorized access. You are responsible for activity through your account.

The service

XSkills imports eligible X bookmarks, evaluates and researches saved workflows, generates agent-skill drafts, presents them for review, and delivers approved packages to your selected destination. Connected services may require separate accounts and permissions.

Generated material may be incomplete, inaccurate, or unsuitable for a particular use. XSkills does not install a package until an approval is recorded for that exact package checksum, but you remain responsible for reviewing each package, deciding whether to approve it, and supervising its downstream use. XSkills stores packaged scripts as text and does not execute them for you.

Subscriptions and billing

Paid plans renew automatically at the monthly or annual interval shown at purchase until canceled. Starter skill allowances reset each month and do not roll over. Pro includes unlimited skill generation, subject to reasonable technical safeguards against automated abuse. Prices and applicable taxes are shown before purchase and payments are processed by Stripe. Starter skill drafts temporarily reserve allowance capacity. A reservation is consumed when you approve the skill and is returned when you reject it or the review expires. Credits consumed under an earlier generation-based policy remain counted until their normal monthly reset.

Upgrades from Starter to Pro, and a change from monthly Pro to annual Pro, may take effect immediately and be prorated. Downgrades generally take effect after the current paid term. You may manage or cancel a subscription through the Stripe billing portal; cancellation takes effect at the end of the current paid term unless account deletion requires immediate cancellation. Payments are nonrefundable except where required by law.

Acceptable use

You may not use XSkills to:

• violate law, third-party rights, or a connected provider’s terms;
• access accounts or data without authorization;
• upload, expose, or distribute credentials, secrets, or malware;
• create destructive, deceptive, abusive, or unsafe automation without appropriate authorization, review, and safeguards;
• interfere with the service, bypass limits or security controls, scrape the service, or reverse engineer non-public components except where law expressly permits it.

Your content and generated packages

You retain your rights in content and information you provide. You grant XSkills a limited, worldwide license to host, process, reproduce, and transmit that material only as needed to provide, secure, and improve the service and comply with law. You represent that you have the rights and permissions needed for the material and connected accounts you provide.

As between you and XSkills, you own delivered skill packages generated specifically for you to the extent ownership is available under law. That ownership does not override rights in source posts, research, software, trademarks, models, or other third-party material. XSkills and its licensors retain all rights in the service, software, design, models, documentation, and technology used to provide it.

Third-party services

XSkills relies on services such as X, Telegram, Stripe, OpenAI, Firecrawl, Supabase, Vercel, and your selected agent harness. Their terms and policies govern your use of their services. XSkills is not responsible for third-party services, content, changes, outages, or decisions, and their availability may affect XSkills.

Changes, suspension, and termination

We may modify, suspend, or discontinue features and may update pricing or plan limits prospectively. We will provide notice when required by law. We may suspend or terminate access for a material breach, unlawful use, security risk, nonpayment, or conduct that could harm XSkills, users, or third parties. You may stop using the service at any time and may delete your account from Settings.

Disclaimers

To the fullest extent permitted by law, the service and all generated material are provided “as is” and “as available.” XSkills disclaims all express and implied warranties, including merchantability, fitness for a particular purpose, noninfringement, accuracy, and uninterrupted or error-free operation. Nothing in these Terms excludes a warranty that cannot lawfully be excluded.

Limitation of liability

To the fullest extent permitted by law, XSkills will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunity. XSkills’ total aggregate liability arising from or relating to the service or these Terms will not exceed the fees you paid to XSkills during the 12 months before the event giving rise to the claim. These limits do not apply where prohibited by law.

Indemnification

To the extent permitted by law, you will defend and indemnify XSkills from third-party claims, damages, and reasonable costs arising from your unlawful use of the service, content you provide, violation of third-party rights, or material breach of these Terms. This obligation does not apply to the extent a claim results from XSkills’ own unlawful conduct.

Governing law and disputes

California law governs these Terms without regard to conflict-of-law principles. Any dispute must be brought in the state or federal courts located in Los Angeles County, California, and each party consents to their jurisdiction and venue. Nothing prevents either party from bringing an eligible claim in small claims court.

General terms

These Terms and the Privacy Policy are the entire agreement concerning the service. If a provision is unenforceable, it will be modified only as necessary and the remaining provisions will remain effective. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; XSkills may assign them as part of a reorganization, financing, merger, acquisition, or sale. Provisions that by their nature should survive termination will survive.

Changes to these Terms

We may update these Terms from time to time. We will post the updated version here, revise the effective date, and provide additional notice when required by law. Continued use after the updated Terms take effect means you accept them.
